§ 1-8.2. Applicability of the comprehensive plan and law.
The mayor and council and the Commission, in its advisory recommendation to the Mayor and council, shall consider the proposed zoning amendment or conditional use in light of the factors set forth in Section 1-8 or Section 1-9, as applicable. In evaluating the factors set forth in Section 1-8 it shall be the policy of the City to exercise its zoning power in conformity with the adopted policies and intent of the current and adopted comprehensive plan of the City, insofar as the plan is current in its application to development patterns in the area sought to be zoned or rezoned. The policy of the City is to exercise its zoning power for purposes of assuring the compatibility of usage of adjacent and nearby properties and the preservation of the economic value of adjacent and nearby properties, while enabling a use of all properties measured by the U.S. Constitution and the Georgia Constitution.
