§ 1-9.1. Factors for consideration of conditional uses.

  • A permit for a conditional use (special use) shall be approved or denied, provided that due consideration is given to the following objective factors as applicable to the specific use proposed at the specific site requested and the subjective consideration of Section 1-8.2 of this Ordinance.

    a)

    Whether the proposed use will be consistent with the comprehensive plan for the physical development of the district, including any master plan or portion thereof adopted by the commission;

    b)

    Whether the proposed use will be in harmony with the general character of the neighborhood considering population density, design, scale and bulk of any proposed new structures, intensity and character of activity, traffic and parking conditions;

    c)

    Whether the proposed use will not be detrimental to the use, peaceful enjoyment, economic value, or development of surrounding properties or the general neighborhood and will cause not objectionable noise, vibrations, fumes, odors, dust, glare, or physical activity, nor will be injurious or likely to create a nuisance;

    d)

    Whether the proposed use will not adversely affect the health, safety, security, morals, or general welfare or residents, visitor or workers in the area; and

    e)

    Whether the proposed use will be served by adequate public services and facilities including schools, police and fire protection, water, sanitary sewers, public roads, storm drainage, and other public improvements.
