§ 66-3. Vehicle registration.

  • This section of the city Code, with appropriate subsections to be determined by the code revision committee and expressly delegated by the authority of the City of Ringgold to the Municipal Code Corporation, is and are enacted as follows:

    (1)

    Definitions.

    a.

    As used in this section, the term "resident" means a person, firm, or corporation who has a permanent home, domicile or place of abode within the city limits of Ringgold, Georgia. A rebuttable presumption shall exist that any person who has been present in within the city limits for at least 30 days is a resident, regardless of whether said days are consecutive. The fact that a person as defined in this section shall have more than one residence or domicile shall not vitiate the requirements of this section.

    b.

    As used in this section, the term "motor vehicle" means each motor vehicle, tractor, trailer, semi-trailer, special mobile equipment, motorcycle, or other vehicle required to be registered and licensed under O.C.G.A. §§ 40-2-8 and 40-2-20.

    (2)

    [Provisions.]

    a.

    It shall be unlawful for any resident of the City of Ringgold who owns, rents or leases a motor vehicle to fail to register said vehicle with State of Georgia pursuant to O.C.G.A. §§ 40-2-8 and 40-2-20 within 30 days of residing in the city limits.

    b.

    It shall be unlawful for any resident of the City of Ringgold who purchases, rents or leases a new or used motor vehicle to fail to register said vehicle with State of Georgia pursuant to O.C.G.A. §§ 40-2-8 and 40-2-20 within 30 days of taking possession of said vehicle.

    (3)

    Penalty for violation. Any person found guilty of violating this section shall be guilty of a misdemeanor and may be punished, in the discretion of the court, by a fine not exceeding $500.00 for the first violation and not exceeding $1,000.00 or 30 days jail, 60 hours community service, or all for a second or subsequent violation.
