§ 1-10.2. Advisory recommendation content; time limit; withdrawal.
Upon conclusion of the public hearing before the Commission, the Commission may make a recommendation to either approve, disapprove, or table the proposed zoning amendment or conditional use. If consideration of the proposed zoning amendment or conditional use is tabled, it shall be reconsidered by the Commission not later than sixty (60) days after the close of the public hearing. If the Commission tables their recommendation, then the scheduled public hearing of the mayor and council may continue, however the mayor and council shall await the recommendation of the commission before taking final action. The rules of the Commission shall provide for a regular monthly meeting during each calendar month. If no advisory recommendation is submitted to the mayor and council within sixty (60) days of the close of the public hearing on any zoning amendment or conditional use, the Commission shall be deemed to have made a favorable recommendation of the proposed zoning amendment or conditional use. The application for zoning amendment or conditional use shall not be withdrawn once the Commission opens and conducts the public hearing. The Commission shall make a recommendation to the mayor and council on the proposed zoning amendment or conditional use regardless whether the proponent of the zoning amendment or conditional use attempts to, thereafter, withdraw his/her application of the zoning amendment or conditional use.
